On April 3, 19-year-old Jesse Jordan received a call that changed his life.

The freshman at Rensselaer Polytechnic Institute in Troy, N.Y., learned he was being sued by one of the most powerful trade groups in the United States, the Recording Industry Association of America...


This story is making the rounds of the Internet right now, and has been the #1 story on blogdex since this morning. Poor Jesse Jordan set up a general-purpose peer-to-peer file-sharing engine on campus and after being threatened with a massive lawsuit by the RIAA, he has settled out of court and will be paying them his entire life savings: $12,000. I'm sure this seems wrong to many people -- but why?

Here I am at yet another one of our favorite self-validating events- the ever present "New Media Conference". What better way to begin the momentous multi-day gathering, than with an ice breaker game! Our moderator has placed words into a hat. We are each to draw a word and use it in a sentence about the goals for the weekend, a sort of group manifesto using contrived words from the magicians hat... But here is my question, where did these words come from? The very words in which we are supposed to describe our selves, define ourselves, our goals, our objectives. Are these not contrived, preassigned, ordered from the new media dictionary via the man behind the curtain?

Eine Sache, die mir recht häufig im Kopf rumgeht, und gestern gerade bei einer Diskussion wieder hochkam
Ist von Adorno, dass Kunstwerke innerhalb der Kulturindustrie nicht mehr auch Ware sind, sondern nur noch Ware.Ich kann dem Meister der Kulturindustrie einfach nicht folgen. Vielmehr sehe ich in allem auch eine kulturelle Bedeutung, wie andersherum alles Ware sein kann.

What does it mean to think of, articulate, or be artistic practice today? Up until recently I have had expressed anxiety about the medium and type of practice I have been engaged in, fretting about such things as 'the new' and my gesture produced in conjunction with 'the new' rather than the modes and mechanisms of production themselves. These modes and mechanisms of course are modes and mechanisms of multiplicity: of rhythm and chorus; of frightfully playful and directed collaboration, inside and outside of the frame.

The computer game `Escape from Woomera', has caused a wee feeding frenzy over the past week, as Australia's immigration minister, Philip Ruddock, discovered the game's development funding has come from his own government's purse. The Australia Council for the Arts has thrown $25,000 at the development of a 3D adventure game, that invites gamers to assume the character of, and `live' through the experiences of a modern day refugee.

Even though I am new to weblogging I sense its power to generate a kind of intellectual freshness. I am an academic, writer, performer and based in the USA. I have been experimenting with writing styles and performative modes, sometimes in collaboration with my students, and notice that the web can generate unusually sharp ideas and conversations in very short amounts of time. It has been daunting for me to observe the clash between academic quality and other qualities of the mind.
